Welcome to ChatQURE ("Company", "we", "our", "us"). These Terms & Conditions ("Terms") govern your access to and use of our mobile applications (including Android and iOS applications), website, webpages, and related digital services (collectively, the "Service").
By accessing or using the Service through our Android application, iOS application, website, or any associated webpages, you agree to be bound by these Terms.
If you do not agree with these Terms, you may not access or use the Service.
1. Services Provided
1.1 ChatQURE provides a digital healthcare platform that enables patients to consult with licensed medical professionals through chat, audio calls, or video calls.
1.2 Consultations are charged on a per-minute basis, and the applicable rate will be displayed before the consultation begins.
1.3 Currently, the Service does not provide medicine delivery, laboratory testing, or offline appointments.
1.4 ChatQURE may introduce additional healthcare services in the future.
1A. Categories of Services & Practitioners
ChatQURE provides access to multiple categories of service providers. Users are required to select the appropriate category before initiating a consultation.
(a) Medical Doctors (Allopathy)
Includes General Physicians and Specialist Doctors licensed under modern medicine. These practitioners may provide consultation, diagnosis, and prescriptions in accordance with applicable laws in India.
(b) AYUSH Practitioners
Includes practitioners of Ayurveda, Homeopathy, Unani, and Naturopathy systems of medicine. Consultations and treatments are provided strictly as per their respective systems of medicine. Advice and prescriptions (if provided) are limited to their recognized domain of practice.
(c) Wellness Experts
Includes professionals and wellness consultants. These services are non-medical in nature. No diagnosis, prescription, or medical treatment is provided under this category.
(d) Veterinary Services
Includes licensed veterinary professionals. These services are strictly limited to animal healthcare and must not be used for human medical concerns.
User Acknowledgment
By using the platform, users acknowledge that:
• They are responsible for selecting the correct category of service.
• ChatQURE is not liable for any consequences arising from incorrect category selection.
2. User Eligibility
2.1 Users must be at least 18 years of age or the legal age in their jurisdiction to use the Service.
2.2 Users agree to provide accurate, complete, and up-to-date information when creating an account or using the Service.
3. Account Responsibilities
3.1 Users are responsible for maintaining the confidentiality of their account credentials.
3.2 Users are responsible for all activities conducted under their account.
3.3 Users must notify ChatQURE immediately in case of unauthorized access or security breaches.
4. Payment & Billing
4.1 Consultations are billed on a per-minute basis.
4.2 The consultation rate will be displayed before the consultation request is initiated.
4.3 Payments must be made using the payment methods available within the platform.
4.4 Refunds or cancellations are governed by the ChatQURE Refund Policy.
4.5 Users are responsible for any applicable taxes or government charges.
5. Medical Disclaimer
5.1 ChatQURE facilitates telemedicine consultations between patients and doctors.
5.2 The Service does not replace emergency medical care.
5.3 In case of a medical emergency, users should immediately contact local emergency services or visit the nearest hospital.
5.4 ChatQURE is not responsible for any diagnosis, treatment, medical advice, or outcomes provided by doctors.
Different categories of practitioners available on the platform operate within their respective domains as defined in Section 1A.
6. User Conduct
Users agree not to:
- Use the Service for unlawful purposes
- Provide false or misleading information
- Impersonate another person
- Harass, threaten, or harm doctors or other users
- Attempt to disrupt or compromise the platform's security
7. Doctor Verification & KYC
7.1 ChatQURE conducts a Know Your Customer (KYC) and professional verification process before allowing doctors to provide consultations on the platform.
7.2 Doctors may be required to submit documents including:
- Medical degrees and educational qualifications
- Aadhaar Card
- PAN Card
- Valid Medical Registration Number
- Registration with the State Medical Council or National Medical Commission (NMC)
7.3 The purpose of this process is to verify that the doctor is a licensed medical professional legally permitted to provide consultation services.
7.4 While ChatQURE performs reasonable verification checks, the platform does not guarantee the continued validity or accuracy of the information provided by doctors.
8. Consultation Request Process
8.1 When a patient clicks the "Consult" button, a "Please Wait" pop-up will appear indicating that a consultation request has been sent to the doctor.
8.2 The patient must wait up to 60 seconds for the doctor to respond.
8.3 During this time, the doctor has the right to accept or reject the consultation request.
8.4 If the doctor accepts the request within 60 seconds, both the patient and doctor will be redirected to the consultation chat interface.
8.5 Within the consultation interface, communication may occur via:
- Text chat
- Audio call
- Video call
8.6 If the doctor does not accept the consultation request within 60 seconds, the request will automatically expire and be rejected.
9. Intellectual Property
All content, trademarks, logos, design elements, and materials available on the Service are owned by ChatQURE or its licensors. Users may not copy, distribute, modify, or reproduce such materials without prior written permission.
10. Limitation of Liability
10.1 ChatQURE shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service.
10.2 ChatQURE does not guarantee the availability, accuracy, or reliability of consultations conducted through the platform.
11. Future Services
ChatQURE may introduce additional healthcare services in the future, including but not limited to:
- Medicine delivery
- Laboratory testing
- Health monitoring tools
Such services will be governed by updated Terms & Conditions.
12. Privacy
Use of the Service is also governed by the ChatQURE Privacy Policy, which explains how user data is collected, used, and stored.
13. Account Deletion & Reactivation
13.1 If a user requests account deletion, the account will be scheduled for permanent deletion after 30 days.
13.2 During the 30-day period, the account will remain deactivated.
13.3 If the user logs in again within 30 days, the account will be reactivated and the deletion request will be canceled.
13.4 After 30 days, the account and related data may be permanently deleted and cannot be recovered.
14. Telemedicine Compliance
14.1 Consultations conducted through ChatQURE are intended to comply with telemedicine practice guidelines applicable in India.
14.2 Doctors are responsible for complying with medical laws, ethical standards, and regulatory requirements.
14.3 Telemedicine consultations may have limitations compared to physical examinations.
14.4 Doctors may advise patients to visit a clinic or hospital when necessary.
15. Prescription Policy
15.1 Doctors may issue digital prescriptions during consultation where legally permitted.
15.2 Prescriptions are issued at the sole discretion of the consulting doctor.
15.3 Certain medications, including restricted or controlled substances, may not be prescribed through teleconsultation.
15.4 ChatQURE does not guarantee that a prescription will be issued in every consultation.
16. Platform Role & Liability Clarification
16.1 ChatQURE operates solely as a technology platform connecting patients with independent medical professionals.
16.2 Doctors using the platform are independent professionals and not employees or agents of ChatQURE.
16.3 ChatQURE does not practice medicine and does not directly provide medical treatment.
16.4 All medical advice, diagnosis, and treatment decisions are the responsibility of the consulting doctor.
16.5 ChatQURE only facilitates communication between patients and doctors.
17. Consultation Recording & Data Storage
17.1 ChatQURE may store consultation-related data to improve services, maintain records, and resolve disputes.
17.2 Such data may include:
- Chat conversations
- Consultation timestamps
- Digital prescriptions
- Medical information shared during consultations
17.3 All stored data is handled in accordance with the Privacy Policy and applicable laws in India.
17.4 By using the Service, users consent to the collection and storage of consultation-related information.
18. Termination
ChatQURE may suspend or terminate user accounts if users violate these Terms or misuse the Service.
19. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.
20. Amendments
ChatQURE may update or modify these Terms at any time.
Updated Terms will become effective immediately upon posting.
Users are responsible for reviewing the Terms periodically.
